The Branch of Family Law

Family law is a branch of the legal system that deals with the issues that are presented within a family. Some of the state family laws that help determine who will gain custody of a child is the parents’ moral character, the parents’ ability to raise a child, whether or not there is a history of domestic abuse, and the wishes of the parents, as well as the child.

The labor laws have certain variances from state to state that are also recognized.

The Branch of Child Custody Law

Child custody law is one of the components of family law. The main purpose of child custody law is to establish who will be the legal guardian of a child. The child custody laws do not hold exclusivity to the biological parents of a child. This is because one of the chief reasons for the branch of child custody law is to ensure that the child is placed in a situation that is going to offer a safe and loving environment for that child. In order for child custody law to ensure that this is the case, the court takes on the responsibility of deciding who is best fit to care for the child. Not only who is best to care for the child, but who is best to have the final say in making those important decisions in the lives of the child. Although the child custody laws may have a slightly different focus from state to state, this is one of the principles of child custody law that is always upheld in every family court.

It is times where, based on the child custody laws, the court finds that there should be sole custody granted to one of the parents. Then there are other times when a judge sees it to be fit by way of the child custody laws to grant joint custody. There is sometimes when there is a request by the parents to both have custody of the child. It is not always the request of the parents to make this type of child custody arrangement because they plan to assume equal time in which they physically care for the child. The child custody laws permit joint custody even in the most common instances in which a child lives with one parent. The ultimate reason why parents will go to child custody law court in order to issue this request is because they would like to be consulted about the important details that are going on in a child’s life. They will therefore, go to family court to ensure that they both have an equal say in the major decisions that are made in a child’s life.

A couple does not always have to be split in order to take up a matter in child custody law court. There are times when this type of filing is initiated in order to gain the legal recognition that they would like to establish. That way, if there is ever an opportunity where the couple did decide to part ways, there are certain parental rights that will be recognized by the court already. With that being said, this does not mean that this will attribute to a final ruling. If it ever felt that there is a new custody arrangement that either of the parents would like to establish, they may take the matter up in child custody law court, once again.

The Branch of Child Support Law

Child support law encompasses making the proper arrangements and terms in order to support the financial needs of a child. Child support law was designed so that both parents will actively share in caring for and raising their child. The child support laws were designed so that the guardians would both share in providing the child with a place to live, food to eat, clothing, will be able to meet his or her educational needs, and so that the child has the medical insurance needed. Other special needs of the child are also factored into the child support payment amount.

Child support law is something that is enforced by the court, but this is only the case when it is brought to the attention of the court. One of the ways in which the child support laws are enforced by the court is if the guardian of a child has not been able to receive child support from the other guardian. The state child support laws will also play an active role in determining what the court decides to do in the matter.

The Branch of Divorce Law

Divorce law is the branch of law that encompasses the legal proceedings that determines the final results after a marriage between two partners has ended. Divorce law is a branch of family law. The divorce laws that have been devised encompass legal matters, such as the official dissolve of the marriage, separation, spousal support, child support, child custody, visitation as well as property splitting and financial designation.
