The Branch of Domestic Violence Law

Domestic violence law is the branch of the legal system that decides the final verdict in cases where there is abuse that transpires between or amongst those who share intimate relationships together. Therefore, domestic violence law makes up cases that transpire between those who have a romantic relationship together, those who live together, or family members. The domestic violence laws are highly governed by the laws that are featured within the state legislation. When an alleged act of domestic violence occurs, assuming that the victim is not near death during the course of the event, unless he or she decides to bring the matter to a domestic violence law court, the issue may or may not be addressed on a legal scale. If the prosecution does not have enough evidence to show that the event potentially occurred, it may be up to the victim of the act of domestic violence to see that the person is legally held accountable for his or her actions. Depending on what the alleged act of domestic violence is, the domestic violence laws of the state may or may not consider the act committed to be a criminal act. If the domestic violence laws in the state do consider the act to be such, domestic violence law states that the person may be charged criminally. There are also instances in which there has been a violation of the domestic violence laws, and although the matter may not be deemed a criminal matter, the victim may be able to file a complaint against the individual in a civil court. If the court finds that the accused individual has violated the domestic violence laws, domestic violence law permits the victim to be awarded monetary damages as a result of the incident.

Domestic violence law also has an obvious connection to family law. If it is found that any of the domestic violence laws are violated by a parent or guardian, the court will usually look to the current parental obligation that he or she has. If the violation of the domestic violence law poses a threat to the parental or guardian relationship that the parent or guardian currently has, it may be found that he or she loses all or some of the previously arranged parental responsibilities. This may serve as just cause that his or her violation of the domestic violence laws lead to the immediate removal of the child or children from their care, and from their home.
