The divorce laws that have been devised encompass legal matters, such as the official dissolve of the marriage, separation, spousal support, child support, child custody, visitation as well as property splitting and financial designation. Not all marriages end in divorce. Some married couples stay together. And some married couples separate. The state divorce laws define those instances in which a legal separation will be granted. Some couples decide that they will go to divorce law court in the hopes of legal separation because they would like to spend some time apart, in hopes of reconnecting together and working things out. Then there are those couples that go to divorce law court in hopes of separation because this is the beginning phase of the divorce proceeding that they are planning to initiate. There are some state divorce laws that limit the conditions by which you may apply for a divorce in that particular state. One of the other alternatives that people tend to take when they can not show just cause for an immediate termination of the marriage, is to succumb with the other qualifying component of the state divorce laws, which is to have legally separated for the specified period of time.
When couples reach that point where they are read to enter divorce law court in order to officially end the marriage, one of the divorce laws that they often concern themselves with is spousal support. People have come to find that the divorce laws are not always geared towards giving a monthly annulment payment to the spouse that makes the least money. There are other components that go into deciding upon the terms of spousal support. One of the stipulations that may be made in the state divorce laws of spousal support may be that the spouse would have had to have a financial dependence on the other for the specified portion (usually 50% of the marriage) during the course of the marriage. There are also other factors that the divorce law court considers, depending on what the state legislation dictates.
Also a component of the divorce laws are the matters concerning the children that are involved in the marriage. Although many of the other aspects of the divorce law proceedings will aim its focus on the decisions that are to be made on the basis of the couple. This is a component of the divorce law that is strictly decided with the best interest of the children at the realm of court concern. The divorce law court will thus decide matters of child support, child custody, and visitation with that premise in mind.
